Easley Family Foundation Terms Of Service
In General
Easley Family Foundation “(Easleyfamilyfoundation.org)” owns and operates the Easley Family Reunion. This document governs your relationship with Easley Family Foundation (“Easleyfamilyfoundation.org”). Access to and use of the website, social media, newsletter, and the products and services available through this Easley Family Foundation (collectively, the "services") are subject to the following terms, conditions, and notices (the "Terms of Service"). By using the services, you are agreeing to all the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
Access to our services is permitted on a temporary basis, and we reserve the right to withdraw or amend the services without notice. We will not be liable if for any reason the services, events, or website are unavailable at any time or for any period. From time to time, we may amend some parts or all our services or website.
The website may contain links to other websites (the "linked sites"), which are not operated by Easley Family Foundation and has no control over the linked sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the linked sites will be subject to the terms of use and service contained within each such site.

The Easley Family Foundation strives to ensure the protection of your personal information through responsible practices. We deploy all efforts to protect the private nature of your personal information. Since we may collect information about you using our website, social media page, or email, we feel that it is important that you understand how we collect and use this information. This section summarizes our personal information collection practices. All personal information collected by the Easley Family Foundation is done so exclusively with your consent, by means of a form posted on our website, social media, or email received from you or by telephone. No information is collected automatically. We will not, in any circumstances, share your personal information with other individuals or organizations without your permission, including public organizations, corporations or individuals, except when applicable by law. We do not sell, communicate or divulge your information to any mailing lists. We can offer to add your address to the Easley Family Foundation email or mailing list. In this last case, you may at any time ask us to remove your name or opt out from such lists.

Prohibitions
You must not misuse our services or website. You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb, or any other material which is malicious, technologically harmful, in breach of confidence, or in, any way offensive or obscene; hack into any aspect of the website or abuse our Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through our website, social media, or any other electronic means. Breaching this provision would constitute a criminal offense and Easley Family Foundation may report any such breach to the relevant authorities and disclose your identity to them.
Terms of Sale
By attending a reunion event you are subject to the following terms and conditions. All events are subject to availability and confirmation.
In order to contract with the Easley Family Foundation, you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. The Easley Family Foundation retains the right to refuse any request for contract made by a potential business partner. When placing a bid for a contract, the business partner undertakes that all details provided to us are true and accurate, and they are qualified provider of goods or services requested.
(a) Our Contract
When you place an order or attend and event, you will receive an acknowledgment e-mail confirming receipt of your order: this email will only be an acknowledgment and will not constitute acceptance of your order or intentions. A contract between us will not be formed until we send you confirmation by e-mail that the goods or services which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
(b) Pricing and Availability
While we try and ensure that all details, descriptions, and prices which appear on our website, social media, or newsletter are accurate, errors may occur. If we discover an error in the price of any goods or services which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat the order as canceled.
(c) Payment
Upon receiving your order, we may carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Your card will be debited upon authorization being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods or services you wish to purchase. Once the goods or services have been dispatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of the goods or services you have purchased as listed in the confirmation email.
Cancellation Policy
We understand that unexpected circumstances may arise, and we appreciate your understanding of this cancellation policy. A non-refundable deposit of $50 will be charged for all cancellations.
• Cancellations before January: A full refund will be issued, minus the non-refundable deposit of $50.
• Cancellations between January and June 30th (year of reunion): 50% of the total registration fee (minus the non-refundable deposit) will be refunded. This applies to cancellations made after vendor contracts are finalized in January.
• Cancellations after June 30th or 30 days before the last Thursday of July (year of reunion): No refunds will be issued.
After the event date has passed, refunds will not be provided for registrants who do not attend the family reunion event or conference.
Notice of cancellation must be made via e-mail to easleyfamilyfoundation@gmail.com
A cancellation acknowledgment will be sent within 3 business days and payments made less the $50.00 non-refundable deposit will be refunded within 10 business days.
Vendor Contracts:
Please note that due to vendor contracts being finalized in January of the reunion year, cancellations will only be eligible for a partial refund (minus the non-refundable deposit).
We appreciate your understanding of our cancellation policy.
Cancellations Due to Extenuating Circumstances
Note that circumstances beyond the control of the conference organizers may necessitate
substitutions, alterations, or cancellations of the speakers and/or events. Easley Family Foundation cannot be responsible for travel, attendance, or event issues caused by Acts of God including but not limited to war, illness, strike, acts of terrorism, severe weather, pandemics, or natural disasters. Therefore, the Easley Family Foundation reserves the right to alter or modify the advertised speakers and/or events which may include a virtual event if necessary. Any substitutions or alterations will be updated on the conference website, social media, newsletter, or family letter as soon as possible.
In the rare instance where circumstances arise, a family member may need to cancel a confirmed registration. In such cases, we may elect to forgo the cancellation policy penalties outlined in our Terms of Service. Such cases will be reviewed on an individual basis, as well as, contingent on proper documentation where valid. The Easley Family Foundation reserves the right to make exceptions. We do honor requests for refund or transfer of funds where the following reasons apply:
1. If the Easley Family Foundation cancels the conference or event due to some unforeseen circumstances or non-delivery of the event or service.
2. If the Easley Family Foundation canceled the event or conference before the event date.
3. Death of a family member and/or a Divorce.
Requests for a refund are considered within the guidelines of our Terms of Service. You should accompany this request with detailed and grounded reasons why you are applying for a refund
Family Reunion Refund Policy: Death or Divorce
We understand that life can be unpredictable, and circumstances may sometimes prevent attending a planned family reunion event. This policy outlines the process for requesting a refund for family reunion registration fees in case of a death and/or a divorce of your immediate family member.
Who Can Request a Transfer of Funds?
Transfer of Funds will be issued to the immediate family member(s) of the original registrant or to the person who made the payment on their behalf.
In The Case of a Death
In the event of a death of a family member, a full or partial transfer of funds may be available to the immediate family member(s).
Transfer of funds will be issued based on the original registrant account record and the following terms will apply:
• A transfer of funds can be issued to the account of the spouse and/or immediate family member(s) towards the upcoming reunion.
• If there is no immediate family member involved in the reunion, then the funds will be donated to the Foundation.
In The Case of a Divorce
In the event of a divorce, a full or partial refund may be available to the immediate family member(s).
Transfer of funds will be issued based on the original registrant account record and the following terms will apply:
• A transfer of funds can be issued to the account of an immediate family member(s) towards the upcoming reunion.
• If there is no immediate family member involved in the reunion, then the funds will be donated to the Foundation.
To request a transfer of funds due to a death an immediate family member and/or divorce, please submit a written request to the Board of Directors within thirty (30) days of the family member's passing and/or notice of divorce. The request should include a copy of the death certificate.
Please Note: Additional documentations such as a copy of the death notice or final divorce decree may be required to process the transfer of funds request.

Disclaimer of Liability
The material displayed on our website, social media, or newsletter is provided without any guarantees, conditions, or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Easley Family Foundation and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties, and other terms which might otherwise be implied by statute, common law, or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this website or the linked sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect the Easley Family Foundation's liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.
Indemnity
You agree to indemnify, defend and hold harmless Easley Family Foundation, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from your use this services or website or your breach of the Terms of Service.
Variation
The Easley Family Foundation has the right in its absolute discretion at any time and without notice to amend, remove or vary the services and/or any page of this website.
Invalidity
If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected by all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
Complaints
We operate a complaint handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.
Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Entire Agreement
The above Terms of Service constitute the entire agreement of the parties and supersede all preceding and contemporaneous agreements between you and Easley Family Foundation. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by an Executive Board Member Director of the Easley Family Foundation.

As a family member or customer, you are responsible for understanding the Terms of Service upon purchasing any product, service, or event purchase on our website, social media, or directly from the Board of Directors.
Please note that our Board of Directors is ready to provide you with timely and efficient
professional assistance. We will attempt to find the best convenient solution for your
query. Give us 2-3 business days for our Board to get back to you on the problem.
We meet every third Thursday of the month. If you need to contact the Board, please
email easlyfamilyfoundation@gmail.com. Requests for a refund are considered within
the guidelines of our Terms of Service. You should accompany this request with detailed
and grounded reasons why you are applying for a refund.
